Many strategies have been proposed to address the supply of bespoke essays and other assignments by companies often described as ‘Essay Mills’ with the act of supply and use being invariably described as ‘contract cheating’. These proposals increasingly refer to the law as a solution in common with other action. In this article, the lead author revisits work undertaken in 2016 as a result of recent legal and extra-legal developments to assess whether the UK Fraud Act (2006) might now (...) be used to tackle some of the activities of the companies involved, by comparing their common practises, and their Terms and Conditions, with the Act. It was previously found that all sites have disclaimers regarding the use of their products but there were some obvious contradictions in the activities of the sites which undermined those disclaimers, for example plagiarism-free guarantees for the work. In this article, we ask and consider the question whether this is still the case having regard to the impact of a change in the law by the UK supreme court and recent action of the UK Advertising Standards Authority. We also consider whether a call for a new offence to be created which specifically targets the undesirable behaviours of these companies is still justified. (shrink)

Heyes’ book is an important contribution that rightly integrates cognitive development and cultural evolution. However, understanding the cultural evolution of cognitive gadgets requires a deeper appreciation of complexity, feedback, and self-organization than her book exhibits.

The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be avoided. Insofar (...) as the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

John Stuart Mill's best-known work is On Liberty. In it he declared that Western society was in danger of coming to a standstill. This was an extraordinarily pessimistic claim in view of Britain's global dominance at the time and one that has been insufficiently investigated in the secondary literature. The wanting model was that of China, a once advanced civilization that had apparently ossified. To understand how Mill came to this conclusion requires one to investigate his notion of the stages (...) from barbarism to civilization, and also his belief in imperialism as part of the civilizing process. Here India plays a central role, as both Mill and his father worked for the East India Company. This study, then, investigates the relationship between Mill's liberalism and his justification of imperialism. It takes us into the Utilitarianism of his family background, and such other influences as Romanticism, Scottish political economy and such key French thinkers as Saint- Simon, Guizot, Comte and Tocqueville. Mill, then, provides the focus of a debate on the origins, meaning, and consequences of Western civilization. It encompasses discourses on colonialism and orientalism, on Enlightenment optimism and conservative despair, on the need for leadership and the advance of democracy; in short, on the blessings, curses and dangers of modernization from approximately the time of the American and French revolutions to that of the so-called mid-Victorian calm in which On Liberty was written. Furthermore, current political issues concerning the West and Islamic countries have heightened interest in just the kind of question that this book discusses: that of how the West relates to, and assesses, the rest of the world. J.S. Mill famously equated physical things with "permanent possibilities of sensation." This view, known as phenomenalism, holds that a rock is a tendency for experiences to occur as they do when people perceive a rock, and similarly for all other physical things. The social world contains institutions, groups, objects, and more. This essay explores a puzzle about the essences of social items. There is widespread consensus against social essences because of problematic presuppositions often made about them. But it is argued that essence can be freed from these presuppositions and their problems. Even so, a puzzle still arises. In a Platonic spirit, essences in general seem detached from the world. In an Aristotelian spirit, social essences in particular seem embedded in the world. (...) The puzzle is that these inclinations are individually plausible but jointly incompatible. The essay has four aims: to clarify and refine the puzzle; to explore the puzzle's implications for essence in general and for social essences in particular; to illustrate the fruitfulness of the general distinction between detached and embedded; and to develop this distinction to sketch a novel solution to the puzzle. This paper focuses on the boundaries of political sovereignty, one key aspect of global political justice and an important background condition to the issues of global economic justice treated in the other papers of this volume. I first present an interpretive summary of the traditional arguments against and for intervention, stressing, to a greater extent than is usual, the consequentialist character of the ethics of intervention. It makes a difference whether we think that an intervention will do more good than (...) harm, and some of the factors that determine the outcome are matters of strategy and institutional choice. I then explore the significance of a key factor that makes for much of what is new in the new interventionism: the role of multilateral and particularly U.N. authorization and implementation. I argue that the more salient role of the United Nations should lead us to a more expansive tolerance of international intervention and that global standards of justice, both political and economic, can therefore be more widely enforced against claims to national autonomy. In this essay I argue that Albert would reject the need for a separate fourth mode of common personal supposition, and that his view of merely confused supposition has not been fully explicated by modern scholars. I first examine the various examples of conjunct descent given by modern scholars from his Perutilis logica , and show that Albert clearly adopts it in resolving the sophistic examples involved. Second, I explicate the view of merely confused supposition that Albert defends in his (...) Sophismata , and then attempt to answer the question: which view of merely confused supposition was his final view, the view articulated in the Perutilis logica or the view in the Sophismata ? I conclude that based upon his Sophismata view of merely confused supposition, Albert came to realize the logical strength his revised theory of personal supposition afforded, and consequently, that he is one of the earliest 14th-century logicians to adopt conjunct terminal descent to resolve various sophisms, a move which gave his theory of personal supposition a logical symmetry having two sorts of propositional descents to singulars, and two sorts of terminal descents to singulars. Michael J. Loux here presents a fresh reading of two of the most important books of the Metaphysics, Books Z and H, in which Aristotle presents his mature theory of primary substances. Focusing on the interplay of Aristotle's early and late views, Loux maintans that the later concept of ousia should be understood in terms of a theory of predication that carries interesting implications for contemporary metaphysics. Loux argues that in his first attempt in identifying ousiai in the Categories, (...) Aristotle encountered a set of ontological problems which he wrestled with again in Metaphysics Z and H. In the Categories, where the primary realities are basic subjects of predication construed in essentialist terms as things falling under natural kinds, familiar particulars are the primary ousiai. In subsequent works, Aristotle holds that since familiar particulars come into being and pass away, they must be composites of matter and form; and in Metaphysics Z and H, he explores the implications of this insight for the search for ousia. Maintaining that the substantial forms of familiar particulars are the primary ousiai, the later Aristotle interprets forms as predicable universals rather than as particulars, each uniquely possessed by a single object. Normative realists tend to consider evolutionary debunking arguments as posing epistemological challenges to their view. By understanding Sharon Street’s ‘Darwinian dilemma’ argument in this way, they have overlooked and left unanswered her unique scientific challenge to normative realism. This paper counters Street’s scientific challenge and shows that normative realism is compatible with an evolutionary view of human evaluative judgment. After presenting several problems that her adaptive link account of evaluative judgments faces, I outline and defend an evolutionary byproduct perspective on (...) evaluative judgment. I then argue that a consideration of levels of analysis in biological–behavioral explanation suggests that the realist who adopts the byproduct perspective I outline is not at a prima facie disadvantage to the normative anti-realist on grounds of parsimony. This perspective, I suggest, can enable normative realists to answer evolutionary challenges to their view. (shrink)

Philosophical discussions of the morality of suicide have tended to focus on its justifiability from an agent’s point of view rather than on the justifiability of attempts by others to intervene so as to prevent it. This paper addresses questions of suicide intervention within a broadly Kantian perspective. In such a perspective, a chief task is to determine the motives underlying most suicidal behaviour. Kant wrongly characterizes this motive as one of self-love or the pursuit of happiness. Psychiatric and scientific (...) evidence suggests that suicide is instead motivated by a nihilistic disenchantment with the possibility of happiness which, at its apex, results in the loss of the individual’s conception of her practical identity. Because of this, methods of intervention that appeal to agents’ happiness, while morally benign, will prove ineffective in forestalling suicide. At the same time, more aggressive methods violate the Kantian concern for autonomy. This apparent dilemma can be resolved by seeing suicide intervention as an action undertaken in non-ideal circumstances, where otherwise unjustified manipulation, coercion, or paternalism are morally permitted. This review essay examines Stephen Wolfe’s The Case for Christian Nationalism, focusing on his presentation of his book as a work of Christian political theory. His claims regarding national will and agency are analyzed, and problems with them are traced to his political theology and his methodological assumptions about Christian political theory. In place of those assumptions, Kuyper’s idea of architectonic critique is recommended as a more fruitful approach to Christian political theory in the Reformed tradition.

According to vitalism, living organisms differ from machines and all other inanimate objects by being endowed with an indwelling immaterial directive agency, ‘vital force,’ or entelechy . While support for vitalism fell away in the late nineteenth century many biologists in the early twentieth century embraced a non vitalist philosophy variously termed organicism/holism/emergentism which aimed at replacing the actions of an immaterial spirit with what was seen as an equivalent but perfectly natural agency—the emergent autonomous activity of the whole organism. (...) Organicists hold that organisms unlike machines are ‘more than the sum of their parts’ and predict that the vital properties of living things can never be explained in terms of mechanical analogies and that the reductionist agenda is doomed to failure. Here we review the current status of the mechanist and organicist conceptions of life particularly as they apply to the cell. We argue that despite the advances in biological knowledge over the past six decades since the molecular biological revolution, especially in the fields of genetics and cell biology the unique properties of living cells have still not been simulated in mechanical systems nor yielded to reductionist—analytical explanations. And we conclude that despite the dominance of the mechanistic–reductionist paradigm through most of the past century the possibility of a twentyfirst century organicist revival cannot be easily discounted. In this paper significant challenges are raised with respect to the view that explanation essentially involves unification. These objections are raised specifically with respect to the well-known versions of unificationism developed and defended by Michael Friedman and Philip Kitcher. The objections involve the explanatory regress argument and the concepts of reduction and scientific understanding. Essentially, the contention made here is that these versions of unificationism wrongly assume that reduction secures understanding.

We think about and refer to things that we’ve never perceived or experienced. This paper bears on how this could be. Someone is testimonially acquainted with something just in case the explanation of one’s ability to think de re thoughts about it essentially appeals to communication with others who already have that ability. The main motivation for the claim that testimonial acquaintance is possible is that it best explains how we can think de re about and refer to things we’ve (...) never perceived or experienced: we gain these abilities in part by communicating with those who already have them. The main point of this paper is negative: to argue that testimonial acquaintance, as we currently understand it, is impossible. Although one might take this to show that we cannot be acquainted with things we haven’t perceived or experienced, I prefer to think of it as motivation for rethinking the nature of acquaintance. This paper has three interdependent aims. The first is to make Reichenbach’s views on induction and probabilities clearer, especially as they pertain to his pragmatic justification of induction. The second aim is to show how his view of pragmatic justification arises out of his commitment to extensional empiricism and moots the possibility of a non-pragmatic justification of induction. Finally, and most importantly, a formal decision-theoretic account of Reichenbach’s pragmatic justification is offered in terms both of the minimax principle and the (...) dominance principle. Much of the science and religion debate has focussed on statistics. The chapters in this section go beyond bare statistics by examining more nuanced studies of science, religion and education with the aim of developing a deeper understanding of the issues at play when attempting to deal with the issues of science and religion in the classroom.

This book is about an important issue which has arisen within two of the branches of physical science - namely thermodynamics and statistical mechanics - where the notion of entropy plays an essential role. A number of scientists and information theorists have maintained that entropy is a subjective concept and is a measure of human ignorance. Such a view, if it is valid, would create some profound philosophical problems and would tend to undermine the objectivity of the scientific enterprise. Whilst (...) the present volume is not a treatise on thermodynamics or statistical mechanics, all relevant steps in the building up of these disciplines are carefully scrutinised and it is concluded that the charge of subjectivity cannot be upheld. The widely adopted view that entropy is a measure of disorder, or of lack of information, is shown to be ambiguous, although it may be of use in certain contexts. (shrink)

This article examines the work of the nineteenth-century legal theorist, philosopher, and political radical, Joseph Rey (1799-1855). It explores Rey’s serious engagement with Benthamite utilitarianism, philosophical radicalism, and Owenism. It examines how Rey radically re-theorised the principle of utility by fundamentally re-thinking the individual and her creative potentialities, situating both within a radically egalitarian system of co-operation that was inspired both by Owenism and the radical egalitarianism of the democratic communism of the 1790s. Rey’s long-neglected fusion of utility and equality (...) represented a thoroughgoing and novel transformation of utilitarianism that far surpassed in its originality J.S. Given the sheer vastness of the totality of contemporary human knowledge and our individual epistemic finitude it is commonplace for those of us who lack knowledge with respect to some proposition(s) to appeal to experts (those who do have knowledge with respect to that proposition(s)) as an epistemic resource. Of course, much ink has been spilled on this issue and so concern here will be very narrowly focused on testimony in the context of epistemological views that incorporate evidentialism and internalism, (...) and which are either reductivist or non-reductivist in nature. Also, as the main question about testimony addressed here is whether or not testimony can provide any basic justification at all, attention will be narrowly focused on the simple case where one is presented with testimony that something is the case from only one source and on one occasion. It turns out that there are some seriously odd epistemic features of such appeals to expertise that arise both for those who intend to accept internalism, evidentialism and reductivism about justification by testimony and for those who intend to accept internalism, evidentialism and non-reductivism about justification by testimony.
